Hearing Process

The Agency provides program participant an opportunity for an informal hearing for the following reasons: 

Determination of family income or adjusted income and the calculation of amount the housing agency will pay toward rent.

Appropriate utility allowance used from the agency’s schedule.

Unit size determination.

Determination to terminate assistance for violation of family obligations.

Determination of an owner claim for damages and/or unpaid rent.

When a decision on the above items has been made, the agency will inform the client in writing and give the participant 15 days to request an informal hearing. A hearing request form will be provided.

If the participant requests an informal hearing, the agency will first schedule a conference with the participant to explain the decision and give the participant the opportunity to discuss the decision with housing agency staff.

If the participant still wants an informal hearing after the conference, the agency will schedule the informal hearing and notify the participant of the date, time and location of the hearing. The family has the right to request copies of information from their client file and to bring witnesses and legal representation to the hearing.

At the informal hearing a hearing officer will ask for information the housing agency used to make its determination. The participant will have the opportunity to present any information that will prove their case.

The Hearing Officer will notify the Housing Agency and the program participant in writing of his decision two weeks after the informal hearing is completed.
