Contract Termination

Parent  ]
The Housing Assistance Payment Contract (HAP) is terminated when:
(See HAP Contract HUD-52641 (3/2000) Section 4 part b)
1. The owner or tenant terminates the lease. (Check with your Housing Authority regarding the procedures for the family to request a voluntary move)

2. The Housing Authority terminates program assistance for any grounds authorized in accordance with HUD requirements. (Violation of Family Obligations)

3. If the family moves from the contract unit, the HAP contract terminates automatically (often referred to as a "skip").

4. The HAP contract terminates automatically 180 calendar days after the last housing assistance payment to the owner (This is usually due to family being over-income, or abatement of the rental unit).

5. The Housing Authority may terminate the HAP contact if the Housing Authority determines in accordance with HUD requirements, that available program funding is not sufficient to support continued assistance for families in the program.

6. The Housing Authority may terminate the HAP contract if the Housing Authority determines that the contract unit does not provide adequate space in accordance with the HQS because of an increase in family size or a change in family composition.

7. If the family breaks up, the Housing Authority may terminate the HAP contract, or may continue housing assistance payments on behalf of family members who remain in the contract unit.

8. The Housing Authority may terminate the HAP contact if the Housing Authority determines that the unit does not meet all requirements of the HQS, or determines that the owner has otherwise breached the HAP contract.
